?WASHINGTON--(ENEWSPF)--October 29, 2012. ?A federal jury in Detroit on Friday convicted a physician, a home health agency owner and a patient recruiter for their participation in a $14.5 million Medicare fraud scheme, announced Assistant Attorney General Lanny A. Breuer of the Justice Department?s Criminal Division; U.S. Attorney Barbara L. McQuade of the Eastern District of Michigan; Robert Foley III, Special Agent in Charge of the FBI Detroit Field Office; and Special Agent in Charge Lamont Pugh, III of the HHS Office of Inspector General (HHS-OIG), Office of Investigations Detroit Office.

Dr. Pramod Raval, 59, was found guilty in U.S. District Court for the Eastern District of Michigan of one count of conspiracy to commit health care fraud and one count of conspiracy to solicit or receive health care kickbacks in exchange for referring patients to two Detroit area home health care companies, Patient Choice Home Healthcare Inc. and All American Home Care Inc.?

Chiradeep Gupta, 38, a physical therapist and part-owner of All American, was found guilty of one count of conspiracy to commit health care fraud, one count of conspiracy to commit money laundering and three substantive counts of money laundering.?

Richard Shannon, 39, a patient recruiter, was found guilty of one count of conspiracy to commit health care fraud.

The defendants were charged in a superseding indictment returned March 27, 2012.? Sixteen other individuals who worked at or were associated with Patient Choice and All American have previously pleaded guilty.???

According to evidence presented at trial, the defendants and their co-conspirators caused the submission of false and fraudulent claims to Medicare through Patient Choice and All American, two home health care companies located in Oak Park, Mich., that purported to provide skilled nursing and physical therapy services to Medicare beneficiaries in the greater Detroit area.?

The evidence showed that the defendants and their co-conspirators used patient recruiters, who paid Medicare beneficiaries to sign blank documents for physical therapy services that were never provided and/or medically unnecessary.? The owners of Patient Choice and All American paid physicians to sign referrals and other therapy documents necessary to bill Medicare.? Physical therapists and physical therapist assistants? provided through contractors would then create fake medical records using the blank, pre-signed forms obtained by the patient recruiters to make it appear as if physical therapy services were actually rendered, when, in fact, the services had not been rendered.?

According to evidence presented at trial, Raval referred both patients from his own practice and patients brought into the scheme by recruiters to Patient Choice and All American in exchange for kickbacks. Gupta provided to Patient Choice and All American physical therapists and physical therapist assistants who created fake patient files using blank, pre-signed forms obtained by patient recruiters, to make it appear as if the physical therapy services billed to Medicare had actually been given.? Gupta also doctored and directed the doctoring of fake patient files.? The evidence at trial showed that Gupta laundered the proceeds of the fraud through multiple shell companies.? Shannon paid patients in cash in order to obtain their signatures on blank physical therapy forms used to create fake therapy documents.

Vishnu Meda, a physical therapist assistant at Patient Choice and All American, was acquitted today of one count of conspiracy to commit health care fraud.?

The case was prosecuted by Assistant Chief Gejaa T. Gobena and Trial Attorneys Catherine K. Dick and Niall M. O?Donnell of the Criminal Division?s Fraud Section.? The investigation was led by the FBI and HHS-OIG, and was brought by the Medicare Fraud Strike Force, a joint effort of the U.S. Attorney?s Office for the Eastern District of Michigan and the Criminal Division?s Fraud Section.

Since its inception in March 2007, the Medicare Fraud Strike Force, now operating in nine cities across the country, has charged more than 1,480 defendants who have collectively billed the Medicare program for more than $4.8 billion. In addition, HHS?s Centers for Medicare and Medicaid Services, working in conjunction with HHS-OIG, is taking steps to increase accountability and decrease the presence of fraudulent providers.

New England shapes up as Dem firewall for Senate

WASHINGTON (AP) ? Democrats are counting on their New England friends to help them pick up Republican-held Senate seats on Nov. 6 and construct a barrier against losses in Nebraska and elsewhere that could erase their majority.

The National Republican Senatorial Committee has stopped spending money in Maine, where former Gov. Angus King, an independent, leads in the polls and is seen as likely to side with Democrats if he wins. In Massachusetts, Republican Sen. Scott Brown is suddenly considered the underdog against Elizabeth Warren as the state is poised to easily back President Barack Obama over former Gov. Mitt Romney.

"She's closing the argument by linking Brown with national Republicans, who are about as popular around here as the New York Yankees," said Mike Shea, a Democratic strategist in Boston.

Republican hopes of swiping the seat in Connecticut are fading. Democratic Rep. Chris Murphy has steadied his campaign against former wrestling executive Linda McMahon, who spent $50 million on an unsuccessful bid in 2010 and $42.6 million and counting this year. McMahon's less-than-stellar debate performances and the state's Democratic tilt have undercut the GOP candidate's prospects.

"If New England could tip the Senate's balance to the Republicans, it would be fairly earth-shattering," said Rob Gray, a veteran GOP consultant in Massachusetts. "The real question is whether these races will be close-but-no-cigar for Republicans."

In Senate math, the loss of two seats in New England complicates the GOP calculation for majority control. Republicans would have to gain a net of six seats while holding suddenly uncertain Indiana, or a net of five seats if Romney wins the presidency. Democrats currently have the edge 53-47, including two independents who caucus with the party.

On the Election Day ballot are 23 Democratic seats and 10 Republican.

Republicans are optimistic they can make it add up and they point to fresh enthusiasm for Romney and the party ticket. After weeks of pure toss-ups, Republicans say North Dakota and Wisconsin are trending GOP though still close, Montana remains tight and the contest in Ohio has narrowed, due in large part to the roughly $20 million in negative ads against Democratic Sen. Sherrod Brown.

In a late move, the GOP invested $500,000 in Pennsylvania, where some polls show a tight race between first-term Sen. Bob Casey and tea-party backed businessman Tom Smith, who has invested more than $16 million into his bid. The state has been considered safe Democratic for much of the year.

Republicans and Democrats expect Nebraska to switch to the GOP despite the candidacy of former Sen. Bob Kerrey, and Virginia to stay close, with the outcome of the presidential election crucial to the final count.

That's not so in Florida. Romney has grabbed a slight lead in polling, but there are no signs that it has helped Republican Rep. Connie Mack in his race to unseat two-term Democratic Sen. Bill Nelson. In the most telling development, outside Republican groups bailed on the Senate race at the beginning of October and there is no indication they will resume spending in the closing days.

Guy Cecil, executive director of the Democratic Senatorial Campaign Committee, said he was cautiously optimistic about Democrats holding their majority.

"Frankly a lot in our own party gave us little chance to be competitive this cycle, in large part because they were looking at a map where we had two times as many Democratic seats and we were coming off the worse election cycle for Democrats in 75 years," Cecil said. "Certainly despite that fact and the fact that we had seven retirements, we are in a stronger position today than at any point in the cycle."

Privately, Republicans are nervous about Indiana, unsure about the political damage from Republican state treasurer Richard Mourdock's debate comment that pregnancy resulting from rape is "something God intended."

Democrats are spending $1.1 million on an ad saying even Romney and Rep. Mike Pence, who is running for governor, "believe Mourdock goes too far." Worried about Mourdock, the anti-tax Club for Growth, a strong proponent of the Republican in his primary win over six-term Sen. Richard Lugar, invested more money on Friday, raising its state spending to more than $3.5 million.

Up until the debate, Mourdock's race with Rep. Joe Donnelly had been close; the comment could prove decisive in the campaign's closing days.

Republicans dismiss Democratic hopes of capturing the Arizona Senate seat, arguing that Rep. Jeff Flake has consistently maintained a lead in the polls over Richard Carmona. Democrats cringed recently when Carmona told the male moderator at a debate with Flake that he was prettier than CNN's Candy Crowley, who moderated the second presidential debate. Carmona later apologized to Crowley.

Determined to change the trajectory of the race, Democrats released an ad of the state's two Republican senators delivering effusive testimonials about Carmona at his 2002 Senate confirmation hearing for U.S. surgeon general in President George W. Bush's administration.

"One might call him a man for all seasons," says Sen. Jon Kyl.

"He's extraordinarily, perhaps uniquely qualified, to address the need of our nation," Sen. John McCain says.

Republicans have countered with ads in Arizona, Indiana, Montana and North Dakota, linking the Democratic candidates to Obama and in some cases, House Minority Leader Nancy Pelosi, with images of the president and California Democrat.

"Once Heidi was different, but now she's fighting for Obama not us," says a commercial about North Dakota's Heidi Heitkamp, who is in a close race with Rep. Rick Berg.

The GOP spot against Carmona calls him Obama's rubber stamp. The one against Donnelly says a vote for him is a vote for the Obama-Pelosi agenda. "Say no to this yes man," the ad says.

In Missouri, the once vulnerable Democratic Sen. Claire McCaskill is trying to hold onto her seat against Rep. Todd Akin, who severely damaged his candidacy when he said women's bodies can avoid pregnancy in cases of "legitimate rape." National Republicans, including Romney, abandoned Akin, but conservatives and evangelicals still stand behind his candidacy.

SAN FRANCISCO (AP) ? Thousands of baseball fans took to the streets of San Francisco to celebrate the Giants second World Series title in three years as revelers gathered on street corners, in parks and at popular watering holes and car horns blared long into the night.

Fans across the city left their televisions and rushed outside as the Giants defeated the Detroit Tigers Sunday night, greeting diners, bar patrons and other merry makers.

At Polk and Bush streets in the city's Polk Gulch neighborhood, hundreds of fans sprayed champagne, set of off firecrackers and blocked traffic for at least two hours after the game.

Several blocks away, police clad in riot gear looked on as revelers danced around Civic Center plaza where they watched the game on the Jumbotron.

The thousands of fans assembled there exploded in a roar with the final out.

Anthony Yos, 10, hugged his brother Luciano Yos, 15 and the two danced in an embrace with their parents.

"This is the greatest thing," Anthony said with a smile that could go no wider. "The Giants are my favorite team."

Someone in the crowd launched fireworks a few minutes after the game and the park was awash with fans, strangers hugging strangers and wine bottles and marijuana cigarettes being freely passed through the crowd despite a heavy police presence.

'Super storm' Sandy heads toward Northeast coast

MIAMI (Reuters) - Tropical cyclone Sandy revved back up to hurricane strength on Saturday as it churned toward the U.S. northeast coast where it threatens to become one of the worst storms in decades.

The late-season storm has been dubbed "Frankenstorm" by some weather watchers because it will combine elements of a tropical cyclone and a winter storm and is forecast to reach the U.S. coast close to Halloween.

Forecast models show it will have all the ingredients to morph into a so-called "super storm."

Governors in states along the U.S. East Coast declared emergencies on Friday, with officials urging residents to stock up on food, water and batteries.

The U.S. Navy ordered all ships in the Norfolk, Virginia, area, including a nuclear-powered aircraft carrier, out to sea to ride out the approaching storm.

"We're expecting a large, large storm," said Louis Uccellini, director of the National Oceanic and Atmospheric Administration's Center for Environmental Prediction. "The circulation of this storm as it approaches the coast could cover about the eastern third of the United States."

Sandy battered the Bahamas southeast of Florida on Friday after causing widespread destruction in eastern Cuba a day earlier. The storm was expected to crawl northward on Saturday and Sunday and then turn toward the U.S. coast.

Sandy's powerful winds and rains were blamed for 41 deaths in several Caribbean countries, including 11 in Cuba. Most were killed by falling trees and building collapses.

On its current projected track, Sandy could make U.S. landfall on Monday night or Tuesday somewhere between North Carolina and southern New England, forecasters said.

The storm has the potential to cause widespread power outages and to unleash flooding and even dump snow as far inland as Ohio. It also threatens to disrupt air travel along the U.S. East Coast.

At 8 a.m. EDT (1200 GMT), Sandy was about 335 miles southeast of Charleston, South Carolina, and packing top sustained winds of 75 miles per hour, the U.S. National Hurricane Center.

It had earlier dropped just below hurricane strength but little overall change on strength was expected ahead of its anticipated U.S. landfall early next week, the Miami-based Hurricane Center said.

The storm picked up a little forward speed overnight but was still moving slowly over the Atlantic at 10 mph.

PRESIDENTIAL ELECTION

The massive storm has continued to grow in size with tropical force winds extending 450 miles from its center, government forecasters said.

Coming in the final weeks before the U.S. presidential election on November 6, the storm was presenting a challenge to the campaigns of U.S. President Barack Obama and his Republican challenger Mitt Romney.

Romney canceled a rally scheduled for Sunday evening in Virginia Beach, Virginia, while Obama's re-election campaign announced that Vice President Joe Biden had also canceled a Saturday trip to that city.

Ahead of the election, millions of Americans are taking advantage of early voting arrangements to cast their ballots. State officials said they had put in place contingency plans in case Sandy caused extended power outages or other problems that could disrupt voting.

In New York City, officials were considering shutting down the country's largest mass transit system because they were worried the storm's impact could cause flooding or high winds that might endanger subways and buses.

Much of Florida's northeast coast was under a tropical storm warning and storm warnings and watches extended up the coast through most of South Carolina and North Carolina.

Along North Carolina's Outer Banks, which jut out into the Atlantic, vacationers in large camper trailers and motor homes streamed off the barrier islands.

Many forecasters are warning that Sandy could be more destructive than last year's Hurricane Irene, which caused billions of dollars in damage across the U.S. Northeast.

Scientists build 'nanobowls' to protect catalysts needed for better biofuel production

ScienceDaily (Oct. 26, 2012) ? It may sound like a post-season football game for very tiny players, but the "nanobowl" has nothing to do with sports and everything to do with improving the way biofuels are produced. That's the hope of a team of scientists from the Institute for Atom Efficient Chemical Transformations (IACT), an Energy Frontier Research Center led by Argonne National Laboratory (ANL), and including Northwestern University, the University of Wisconsin and Purdue University. The team is using a layering technique developed for microchip manufacturing to build nanoscale (billionth of a meter) "bowls" that protect miniature metal catalysts from the harsh conditions of biofuel refining. Furthermore, the size, shape, and composition of the nanobowls can easily be tailored to enhance their functionality and specificity.

The team, led by Jeffrey Elam, principal chemist in ANL's Energy Systems Division, will present its research during the AVS 59th International Symposium and Exhibition, held Oct. 28-Nov. 2, 2012, in Tampa, Fla.

In recent years, nanoparticles of metals such as platinum, iridium and palladium supported on metal oxide surfaces have been considered as catalysts to convert biomass -- organic matter from plants such as corn, sugarcane and sorghum -- into alternative fuels as efficiently as possible. Unfortunately, under typical biorefining conditions where liquid water may reach temperatures of 200 degrees Celsius (392 degrees Fahrenheit) and pressures of 4,100 kilopascals (600 pounds per square inch), the tiny metal nanoparticles can agglomerate into much larger particles which are not catalytically active. Additionally, these extreme conditions can dissolve the support.

"We needed a method to protect the catalysts without reducing their ability to function as desired during biorefining," Elam says. "Our solution was to use atomic layer deposition [ALD], a process commonly employed by the semiconductor industry to lay down single-atom thick layers of material, to build a 'nanobowl' around the metal particle."

To create a matrix of nanobowls containing active catalysts, the researchers first use ALD to deposit millions of metal nanoparticles (the eventual nanocatalysts) onto a support surface. The next step is to add an organic species that will only bind to the metal nanoparticles and not to the support. This organic "protecting group" serves as the mold around which the nanobowls are shaped.

"Again using ALD, we deposit layer upon layer of an inorganic material known as niobia [niobium pentoxide] around the protecting group to define the shape of the nanobowls in our matrix," Elam says. "Once the desired niobia thickness is reached, we remove the protecting groups and leave our metal nanoparticles sheltered in nanobowls that prevent them from agglomerating. In addition, the niobia coating protects the substrate from the extreme conditions encountered during biorefining."

Elam says that the nanobowls themselves can be made to enhance the overall functionality of the catalyst matrix being produced. "At a specific height, we can put down ALD layers of catalytically active material into the nanobowl walls and create a co-catalyst that will work in tandem with the nanocatalysts. Also, by carefully selecting the organic protecting group, we can tune the size and shape of the nanobowl cavities to target specific molecules in the biomass mixture."

Elam and his colleagues have shown in the laboratory that the nanobowl/nanoparticle combination can survive the high-pressure, high-temperature aqueous environment of biomass refining. They also have demonstrated size and shape selectivity for the nanobowl catalysts. The next goal, he says, is to precisely measure how well the catalysts perform in an actual biomass refining process.

FDA: Pharmacy tied to meningitis outbreak knew of bacteria

WASHINGTON (AP) ? Staffers at a pharmacy linked to the deadly meningitis outbreak documented dozens of cases of mold and bacteria growing in rooms that were supposed to be sterile, according to federal health inspectors.

In a preliminary report on conditions at the pharmacy, the Food and Drug Administration said Friday that even when the contamination at New England Compounding Center exceeded the company's own safety levels, there is no evidence that staffers investigated or corrected the problem. The FDA uncovered some four dozen reports of potential contamination in company records, stretching back to January this year.

The report comes from an FDA inspection of the Framingham, Mass.-based company earlier this month after steroid injections made by the company were tied to an outbreak of fungal meningitis. FDA officials confirmed last week that the black fungus found in the company's vials was the same fungus that has sickened 338 people across the U.S., causing 25 deaths.

The New England Compounding Center's lawyer said Friday the pharmacy "will review this report and will continue our cooperation with the FDA."

Compounding pharmacies like NECC traditionally fill special orders placed by doctors for individual patients, turning out a small number of customized formulas each week. They have traditionally been overseen by state pharmacy boards, though the FDA occasionally steps in when major problems arise. Some pharmacies have grown into much larger businesses in the last 20 years, supplying bulk orders of medicines to hospitals that need a steady supply of drugs on hand.

The FDA report provides new details about NECC's conditions, which were first reported by state officials earlier this week. The drug at the center of the investigation is made without preservative, so it's very important that it be made under highly sterile conditions. Compounding pharmacies prepare their medications in clean rooms, which are supposed to be temperature-controlled and air-filtered to maintain sterility.

But FDA inspectors noted that workers at the pharmacy turned off the clean room's air conditioning every night. FDA regulators said that could interfere with the conditions needed to prevent bacterial growth.

Inspectors also say they found a host of potential contaminants in or around the pharmacy's clean rooms, including green and yellow residues, water droplets and standing water from a leaking boiler.

Additionally, inspectors found "greenish yellow discoloration" inside an autoclave, a piece of equipment used to sterilize vials and stoppers. In another supposedly sterile room inspectors found a "dark, hair-like discoloration" along the wall. Elsewhere FDA staff said that dust from a nearby recycling facility appeared to be drifting into the pharmacy's rooftop air-conditioning system.

The FDA on Friday declined to characterize the severity of the problems at NECC, or to speculate on how they may have led to contamination of the products made by the pharmacy. FDA emphasized that the report is based on "initial observations" and that the agency's investigation is ongoing.

The agency also provided new details about the pharmacy's handling of the steroids it recalled last month. The company recalled three lots of steroids made since May that totaled 17,676 single-dose vials of medicine ? roughly equivalent to 20 gallons. The shots are mainly used to treat back pain.

According to the agency's report, the pharmacy began shipping vials from the August lot to customers on Aug. 17. That was nearly two weeks before the pharmacy received test results from an outside laboratory confirming the sterility of the drug. When FDA scientists went back and tested the same lot this month, they found contamination in 50 vials.

Outside experts said the report paints a picture of a dysfunctional operation.

"The entire pharmacy was an incubator of bacteria and fungus," said Sarah Sellers, a former FDA officer who left the agency in 2008 after unsuccessfully pushing it to increase regulation of compounding pharmacies. She now consults for drug manufacturers. "The pharmacy knew this through monitoring results, and chose to do nothing."

Romney said that Obama is "shrinking from the magnitude of the times" by focusing on "small things." He also said that the president has shrunk from the promises he made as a candidate.

Doctors at Cedars-Sinai and Johns Hopkins have partnered with the Cedars-Sinai's Samuel Oschin Comprehensive Cancer Institute and the Prostate Cancer Foundation as sponsors of the online database they?re calling the National Proactive Surveillance Network.

The network is based upon studies that suggest up to 50 percent of all newly-diagnosed prostate cancer cases are so slow-growing that they pose little-to-no threat to a man?s long-term health.

As a result, more doctors are recommending such patients opt for ?proactive surveillance,? or ?watchful waiting,? before immediately undergoing conventional surgery and radiation ? which can leave them incontinent or impotent, diminishing quality of life while not increasing the patient's lifespan.

Stuart Holden, M.D., director of Cedars-Sinai?s Louis Warschaw Prostate Cancer Center, said the interactive database gives patients a new option.

?They can go online and they will access all their information into this database. It includes lifestyle questionnaires. It includes nutritional databases, which are unique, and ?cause we know that nutrition does have some bearing on this,? he said. ?It allows them to continuously interact through the Web portal both to make sure they make all their follow-up appointments, they can access data as it accumulates from the study.?

Patients who join the online network will receive annual prostate biopsies and provide blood, tissue and urine samples that will be sorted blindly ? without identifying patients by name ? and then used by scientists for future prostate cancer studies. The samples will be banked at Johns Hopkins on the East Coast and Cedars-Sinai in the west.

?There?s been a lot of controversy about screening for prostate cancer, diagnosing prostate cancer, [Prostate-Specific Antigen] PSA prostate cancer and the like," said Holden.

Holden said he hopes the database will help physicians better predict which men might benefit from treatment and which men could safely delay it.

Doctors diagnose about 220,000 men in the U.S. with prostate cancer each year. Nearly 30,000 a year die from it.

Analysis of specific biomarkers in a cerebrospinal fluid sample can differentiate patients with Alzheimer's disease from those with other types of dementia. The method, which is being studied by researchers at Sahlgrenska Academy, may eventually permit earlier detection of Alzheimer's disease.

Due to the similarity of the symptoms, differentiating patients with Alzheimer's from those with other types of dementia ? or patients with Parkinsondisease from those with other motor disorders ? is often difficult.

Making a proper diagnosis is essential if proper treatment and medication are to commence at an early stage. A research team at Sahlgrenska Academy, University of Gothenburg, is developing a new method to differentiate patients with Alzheimer's disease or Parkinson disease by analyzing a cerebrospinal fluid sample.

The study, led by Professor Kaj Blennow and conducted among 450 patients at Sk?ne University Hospital and Sahlgrenska University Hospital, involved testing five proteins that serve as biomarkers for the two diseases.

"Previous studies have shown that Alzheimer's disease is associated with biochemical changes in specific proteins of the brain," says Annika ?hrfelt, a researcher at Sahlgrenska Academy. "This study has found that the inclusion of a new protein can differentiate patients with Alzheimer's disease from those with Lewy body dementia, Parkinson disease dementia and other types of dementia."

Similarly, the biomarkers can differentiate patients with Parkinson disease from those with atypical Parkinsonian disorders.

"Additional studies are needed before the biomarkers can be used in clinical practice during the early stages of disease," says ?hrfelt, "but these results represent an important step along the way."
